Swiss data protection laws apply to the personal data of natural or legal persons, such as companies (called “data subjects”).

Greater legal protection is provided for so-called sensitive personal data and personality profiles, such as administrative or criminal data related to religion, politics and health among others.

6. Data management

The law applies equally to electronic or manual processing of data. Personal data can only be processed lawfully.

The processing of personal data must be done in good faith and must be proportionate.

Personal data may only be used for the purpose specified at the time of collection and this purpose as well as personal data collected must be clearly stated. The data must be correct.

Legal justification for the data processing may be necessary. Data security must be ensured.

In certain circumstances, data files must be registered with the Federal Data Protection Commissioner. Data subjects have the right to access their data and have incorrect data corrected.

The transfer of personal data outside Switzerland is controlled and limited. With certain exceptions, personal data may not be transferred to countries that do not have data protection laws or laws that do not ensure an adequate level of protection.

In certain circumstances, the Federal Data Protection Commissioner must be informed before the transfer takes place abroad.

7. GDPR

What is the GDPR?

Applicable from May 25, 2018, the new Data Protection Regulation – GDPR – has a direct impact on companies that process data from European customers.

Geodata.top, whose European customers constitute a significant part of its turnover, incorporated this new situation as soon as it comes into effect.

The General Data Protection Regulation constitutes the most significant progress in the protection of privacy, for more than twenty years in Europe. It oversees the personal data processing activity of any company offering services to clients based in the European Union. The GDPR therefore has a very wide scope and comes into play when we process the data of natural persons such as identity, contact details, emails, photos or even IP addresses, unique identifiers, locations, among other examples.

A big step towards respect for privacy

With security and privacy at the heart of its concerns, Geodata.top welcomes this change with enthusiasm.

Unprecedented changes

The GDPR extends the control of individuals over their personal data by introducing new rights. As of May 25, 2018, data from European citizens can only be collected and processed with their express consent.

Everyone will not only be able to consult, but also request a copy of all of their data and request their erasure in certain cases.

Another welcome development is the principle of “data protection by design”, in English “privacy by design”. Any organization processing personal data is required to integrate data protection and security in advance, from the early stages of developing solutions for collecting and processing data.

Geodata.top integrates the GDPR

A Swiss company at the crossroads of Europe, Geodata.top operates under particularly rich and strict regulations. A priority of priorities, security represents a commitment well beyond the legal framework.

From a broad perspective, the GDPR is in line with Geodata.top’s desire to place customers and security at the heart of its processes. Geodata.top therefore takes all the necessary measures to ensure full compliance with the GDPR to its customers, as soon as it comes into force.

The data provided by geodata.top is gathered from sources open to the public, in particular HTML code of domains but also from various sources who display this information publicly. Data is essentially non-personal (corporate information). Corporations may request correction of incorrect data as well as update.
