This document describes all of Geodata.top’s general conditions. These conditions are supplemented by the conditions of use of the site and on data protection. customer service email:

  1. Purpose and definitions
    Incorporated in Lisbon, RUDLU Unipessoal LDA (hereinafter “RUDLU or” Geodata.top “or” we offers as agent for the signatory of these terms and conditions services for the sale of products.
    The presentation of the services provided by Geodata.top on its websites (such as Geodata.top) does not represent a binding offer to conclude a contract. Customers must have full legal capacity to contract.
    These General Conditions will only be considered as a contract between the customer (hereinafter also referred to as “you” or “the user” or the “Customer”) and Geodata.top from the day they are accepted. Acceptance will be deemed valid upon signature, including by electronic means, such as email or through site validation, site navigation or payment of an order.
    Access to this service is subject to the opening of an account by the Customer on the Website. The Customer must provide the data allowing his identification. When opening this account, he agrees to provide only accurate information.
    To access this service, the Customer uses the username and password created when opening their account. He undertakes to keep them secret and not to disclose them to any third party. In the event of loss, misappropriation or fraudulent use of his username and / or password, the Customer agrees to immediately notify our customer service.
    These General Conditions are available on the Geodata.top website (www.Geodata.top & www.Geodata.top.fr among others). When creating an account on the site, Geodata.top will consider this Agreement in force and its content valid.
    Geodata.top is entitled to refuse any purchase without giving reasons. In case of refusal, the customer will be informed as soon as possible.
    By accepting these General Conditions, the customer accepts that Geodata.top also has the power to transmit or delegate his order as well as all the elements necessary for its processing to one or more third party (s) in cases where Geodata.top deems it necessary to ensure the best possible execution of the contract.
    With regard to data protection, the customer is bound by Geodata.top’s data protection rules, available on the Geodata.top websites. These rules include a waiver of protection on data transfers abroad. Any such transfers will only take place for the purpose of enabling Geodata.top, if applicable, to fulfill its contractual obligations.
    The use of web services, intellectual property rules and the like form part of these General Conditions and are made available in specific documents on the Geodata.top website (s).
    The customer accepts that all correspondence between Geodata.top and third parties is confidential. Under no circumstances will copies be sent to the customer.
  2. Commercial and Legal Language
    When these General Conditions are translated into a language other than English, this translation should only be taken as a reference. In the event of a conflict between a translated language version and the English language version of these General Conditions, the English language version will prevail.
    Likewise, no form of communication in a language other than English has legal validity.
  3. Proof of the Client’s identity
    Geodata.top may require proof of the identity of the customer. By accepting these General Conditions, the customer agrees to send a scanned copy of an identification document if necessary, at the request of Geodata.top. Usual identification documents are usually a valid passport or identity card, but may be replaced by other identification documents chosen by us.
  4. Orders
    The Products offered on the Website with a description provided by Geodata.top and allowing the Customer to know their essential characteristics and their price. It is up to the Customer to select on the Website the Products he wishes to order, as follows:
    He selects each Product he wishes to buy and adds it to his basket. When he has selected all the Products he wishes to buy, he confirms the contents of his basket and thus places the order.
    He is then directed to a page summarizing the contractual information including details of the selected products, their prices and delivery times and options with their respective costs. He chooses the delivery option, the shipping method if applicable and the payment method that suits him best.
    He then clicks on the purchase button labeled “order” or “purchase” (or equivalent) to confirm and place his order. He accepts the General Conditions of Sale in advance by checking the box provided for this purpose, which allows him to validate his order.
    Once the order has been validated, the Customer receives a confirmation message that their order has been taken into account. The sale is final only after sending, by email, to the Customer, the confirmation of acceptance of the order by the Seller, and after receipt of the full price.
    The Products are shipped to the Customer in accordance with the terms set out in the article concerning deliveries. The Customer receives an email from the Seller informing him of the sending of the items by the Creator. On this occasion, the Seller communicates to him the information relating to the follow-up when available.
    The Customer agrees to obtain invoices for his purchases electronically.
    Product offers are valid as long as they are visible on the site, while stocks last. In the event of unavailability of a Product after validation of the order, the Customer is promptly informed by email and the missing Product (s) is / are promptly canceled and refunded. The Seller reserves the right to cancel or refuse any orders from a Customer with whom there is a dispute relating to the payment of a previous order.
  5. Prices
    The Products are supplied at the current prices listed on the Website, when the order is registered by the Seller.
    The prices are expressed in Euros, including all taxes at the going rate (NB Portuguese VAT is at 23% at time of writing), on the description sheet. The Seller reserves the right to modify the prices at any time.
    The prices indicated do not always include the costs of processing, shipping, transport and delivery, which are invoiced in addition if applicable, under the conditions indicated on the Website and calculated prior to placing the order.
    The payment requested from the Customer corresponds to the total amount of the purchase, including these costs. An electronic invoice is established by the Seller or by Geodata.top in lieu of the Seller and sent to the Customer by email when confirming the shipment of the Products ordered.
  6. Payment, invoicing
    The price is payable in cash, card or bank transfer, in full on the day the order is placed by the Customer, by secure payment, by Visa or MasterCard type bank cards, or Paypal.
    Payments made by the Customer will only be considered final after actual receipt of the sums due to the Seller.
    The Seller reserves the right, in the event of non-compliance with the terms of payment, to suspend or cancel the delivery of pending orders made by the Customer.
  7. Deliveries
    Geodata.top and the Seller make every effort to ensure that the Products are delivered as soon as possible.
    Delivery may be delayed for reasons beyond the control of the Seller.
    In this case, the Seller undertakes to keep the Customer informed of the situation. This information may be provided by third parties (logistics companies) or internet capacity. The seller will notify the customer of the tracking numbers when applicable.
    Geodata.top declines all responsibility in the event of delivery delays, disruptions or errors attributable to suppliers / carriers.
  8. Right of withdrawal
    In accordance with the legal provisions in force, the Customer has a period of fourteen (14) days from receipt of the Product to exercise his right of withdrawal from the Seller, without having to justify reasons or pay a penalty, in order to to return the Product (s) provided that the Products are returned in their original packaging and in perfect condition within fourteen (14) days following the communication of the Customer’s decision to withdraw.
    The right of withdrawal is exercised with Geodata.top using the withdrawal form available on the Website. No other form of submission (email, letter for example) of a withdrawal request will be honored with the exception of that by registered letter.
    The Customer completes the withdrawal form by logging into his personal space located under the withdrawal form section on the Website. He must validate the submission of the form by clicking on the “Submit” button.
    If the withdrawal conditions are met, a confirmation email will be sent to the Customer who must return, at his expense, to the creator whose contact details will be communicated to him or her of the Product (s) concerned within a maximum period of fourteen (14) days following this notification. , accompanied by the return slip.
    The return of Products within the framework of the exercise of the right of withdrawal is carried out in accordance with the conditions described in Article 7 below. The reimbursement of the Products will be made by Geodata.top within fourteen (14) calendar days from the date of receipt of the Products returned by the Custome. The price of the Product (s) purchased and the delivery costs will be refunded to the bank account indicated in the withdrawal form, this bank account must be made out in the name of the buyer, without exceptions.
    Withdrawal right on digital products is not permitted, a reminder of this rule shall be presented by the seller before purchase.
    Reimbursement of unused credits can be requested, a handling fee of €25 is applied.
  9. Limitation of Liability
    Geodata.top does everything in its power to provide the highest level of service; Geodata.top is not responsible for the final quality and the manner in which the products and services provided are performed.
    Geodata.top bases the content of its service on a “best effort basis” and is in no way responsible for the consequences that may result from the incompleteness or inaccuracy of the information. The buyer, when purchasing data from the site, declares having verified the data he is purchasing.
    Geodata.top will never be responsible for any direct or indirect losses of the customer, this also includes indirect losses, emotional damage, business interruption, loss of orders, loss of profit etc.
    The liability of Geodata.top referred to in the previous paragraph, as well as any other liability arising from other facts or circumstances, is limited to the value of the invoice (VAT and costs excluded.) For the service ordered.
    Without prejudice to the provisions of the preceding paragraphs, Geodata.top will never be liable for any loss, on any basis, arising from facts or circumstances which are attributable to third parties designated by the Customer or the Seller.
  10. Assignment and Novation
    You acknowledge that Geodata.top may at its sole discretion and without notice assign or transfer this Agreement, in whole or in part, and / or any of the rights, licenses or obligations therein to any third party.
    You agree that nothing in this Agreement confers, or is intended to confer, on anyone who is not a party to this Agreement, any rights of any kind to enforce any term or provision of this Agreement.
  11. Jurisdiction
    In accordance with the laws of the Swiss Confederation and it is agreed that the Swiss courts of the canton of Geneva have exclusive jurisdiction, the proceedings are conducted in the French language. Nothing in this clause prevents us from seeking and obtaining an injunction or the enforcement of an order from a Swiss court in any other country or jurisdiction.
